Acknowledgment of Risk
I understand that participation in activities at The School of Reps, LLC (“Facility”) involves inherent and significant risks, including but not limited to physical injury, muscle strain, impact from balls or equipment, slips or falls, and injuries resulting from the use of batting cages, pitching machines, high-velocity balls, and shared training spaces. I understand that these risks may result from my own actions, the actions of others, or the condition of the Facility or its equipment.
I knowingly and voluntarily assume all such risks, both known and unknown, on behalf of myself and any minor listed in this agreement, and accept full responsibility for any injury, loss, or damage that may occur. I understand that this agreement applies to all activities occurring on the premises, whether supervised or unsupervised, scheduled or unscheduled. This includes being present in the Facility for any reason, whether actively participating or not.
Release of Liability
In consideration of being allowed to use The Facility, I hereby release and hold harmless The Facility, its owners, employees, coaches, volunteers, and affiliates from any and all claims arising out of or in any way related to loss, injury, or damage that may occur while on the premises, using the Facility, or participating in any activities therein, including any claims arising from the negligence of The Facility or its owners, employees, coaches, volunteers, or affiliates, to the fullest extent permitted by the laws of the State of Colorado.
Personal Equipment
I understand that The Facility does not assume any responsibility for personal equipment brought into The Facility, including but not limited to bats, gloves, helmets, bags, or other gear. I acknowledge that any personal equipment is brought and used at my own risk. The Facility is not liable for any lost, stolen, or damaged personal property while on the premises.
Medical Authorization
In the event of injury or medical emergency, I authorize The Facility staff to provide or seek medical treatment as deemed necessary. I accept full financial responsibility for any medical expenses incurred as a result.
Facility Rules and Conduct
I agree to follow all Facility rules, safety guidelines, and staff instructions. I understand that failure to comply may result in suspension or termination of Facility access without refund. I understand that use of The Facility, including batting cages, training areas, and Study Hall spaces, may occur without direct supervision at all times. I acknowledge that I am responsible for my own safety, or the safety of any minor listed in this agreement, during all use of The Facility. I agree to use all Facility equipment properly and as instructed. I understand that I am responsible for any damage to Facility equipment or property caused by misuse, negligence, or failure to follow rules and instructions.
Indemnification
I agree to indemnify, defend, and hold harmless The Facility, its owners, employees, coaches, volunteers, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in any way related to my use of the Facility and the use of the Facility by any minor listed in this agreement, participation in activities, or presence on the premises, to the fullest extent permitted by the laws of the State of Colorado.
Minor Participant Acknowledgment
If I am signing on behalf of a minor, I certify that I am the parent or legal guardian of the participant. I consent to the minor’s participation in all Facility activities and agree to all terms of this waiver on their behalf. I accept full responsibility for the minor’s conduct and safety while using The Facility. I acknowledge that I have had the opportunity to ask questions regarding this waiver and fully understand the risks associated with the minor’s participation, and agree that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Colorado. I represent that I have legal authority to sign on behalf of each minor listed in this agreement.
Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any legal action arising from this agreement shall be brought in the appropriate courts within the State of Colorado.
Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
